8th Ed. does malekith actually pass panic tests?

the rule says any units wthin 12 inches of malekith pass automatically, but my freind says this includes malekith, i disagree,

who is right?

Is he within 12 inches of himself?
Does the rule explictily exclude him?

I'd say it does include him. Firstly because the rule noes not explicitly exclude himself, and secondly because he's a 5000 year old elf monarch who has literally been to hell and back and arguable the most powerfull elf in existance. I doubt arrows, the odd cannon-ball, and some of his mates getting beaten up in his vicinity would make him even lift an eyebrow.

I'd be liberal with interpreting Malekith's rules. I mean if someone wants to 600-900 points on one model, they are probably already fielding a non-competitive list.
